Your continued use of the website or our services after any update to these terms constitutes your acceptance of the updated terms. 2. About Our Services

CWP Performance Horses provides horse training and related services, including colt starting, foundation groundwork, starting programs for green horses, performance training, conditioning and fitness, and show preparation. Our services are provided by experienced trainers who work with each horse according to a written training plan tailored to that horse.

Our services are equine in nature and involve inherent risks. By engaging our services, you acknowledge that working with horses carries risk of injury to persons and to animals, and you accept responsibility for those risks as described further in the disclaimers section of these terms.

We strive to describe our services accurately on our website and in our communications. However, results vary from horse to horse, and we do not guarantee any specific outcome, competition result, or timeline. Each horse advances at its own pace.

3. Eligibility

You must be at least eighteen years of age, or the age of majority in your jurisdiction, to use our website and to enter into an agreement for our services. By using our website or engaging our services, you represent and warrant that you meet this eligibility requirement.

If you are a parent or guardian engaging our services on behalf of a minor, you agree to be fully responsible for that minor and to accept these terms on their behalf. You further agree to supervise the minor at all times while the minor is on our premises or near our horses.

We reserve the right to refuse service to any person or to decline to work with any horse, in our sole discretion, where we determine that doing so would be unsafe, impractical, or inconsistent with the welfare of the horse or our staff.

4. Your Account and Responsibilities

Certain features of our website or services may require you to provide information such as your name, contact details, and information about your horse. You agree to provide accurate, current, and complete information and to keep that information up to date.

You are responsible for maintaining the confidentiality of any account credentials or access details associated with our services and for all activity that occurs under those credentials. You agree to notify us promptly if you become aware of any unauthorized use of your account or any other breach of security.

You are also responsible for the health, safety, and documentation of any horse you bring to us, including current vaccinations, negative Coggins testing where required, and disclosure of any known health, behavioral, or soundness issues that could affect the safety of our staff or other horses.

5. Booking and Scheduling

Training services are scheduled by mutual agreement between you and our team. Bookings may be made by email, by telephone, or through the contact form on our website. A booking is confirmed only when we provide written confirmation and, where applicable, receive any required deposit.

We will make reasonable efforts to accommodate your preferred schedule. However, scheduling depends on trainer availability, facility capacity, and the needs of other clients, and we cannot guarantee a specific start date or session time.

You are responsible for ensuring that your horse is delivered to our facility on the agreed schedule and is fit to train. If your horse arrives late, unfit, or with an undisclosed condition, we may need to adjust the schedule, and additional fees may apply.

6. Fees and Payment

The fees for our services are described on our website or are provided to you in writing before you book. Fees may vary depending on the program selected, the duration of training, and the specific needs of your horse. All fees are stated in United States dollars unless we agree otherwise in writing.

Payment terms will be set out in your booking confirmation or service agreement. We may require a deposit to secure a training slot, with the remaining balance due according to the agreed schedule. Late payments may result in suspension of services until the account is brought current.

You are responsible for any additional costs not included in your program, such as veterinary care, farrier services, show entry fees, and transportation, unless those costs are expressly included in your agreement. We will notify you before incurring any additional cost on your behalf where reasonably possible.

7. Cancellation and Rescheduling

If you need to cancel or reschedule a session or program, please notify us as early as possible so that we can adjust our schedule and offer the slot to another client. Cancellations and rescheduling requests are subject to the notice periods and policies described in your booking confirmation.

We may need to cancel or reschedule a session due to weather, trainer availability, facility maintenance, or the health or safety of the horse or staff. If we cancel a session, we will work with you to reschedule at no additional charge, or we will credit or refund the session fee as described in the refund section below.

Repeated no-shows or late cancellations may result in the forfeiture of deposits or the termination of your program in accordance with the termination section of these terms.

8. Refund Policy

Refunds are handled according to the terms of your specific service agreement. In general, deposits are non-refundable except where we cancel the service before it begins or where applicable law requires a refund.

If you prepay for a program and we are unable to provide the services through no fault of your own, we will refund the unused portion of your payment on a pro-rated basis or offer you a credit toward future services. If you choose to end a program early, the refund, if any, will be calculated according to the terms of your agreement.

Any refund request must be submitted in writing to agent@cwphorses.hair. We will review each request fairly and respond within a reasonable timeframe. Nothing in this policy limits any refund rights you may have under applicable consumer protection law.

9. Acceptable Use

You agree to use our website and services only for lawful purposes and in a manner consistent with these terms. You agree not to use the website in any way that could damage, disable, or impair the website or interfere with the use of it by any other party.

You agree not to attempt to gain unauthorized access to our systems, to upload malicious code, to scrape or harvest data, or to use the website to transmit spam or unlawful content. You agree not to misrepresent your identity or your authority when interacting with us.

When interacting with our horses and staff, you agree to behave respectfully and to follow all safety instructions provided by our trainers. We may refuse or end service to anyone who behaves in a way that is unsafe, abusive, or disruptive.

You may terminate your service agreement at any time by providing written notice to us, subject to any notice periods and refund terms described in your agreement. Upon termination, any obligations that by their nature should survive termination, including payment obligations and the disclaimers and limitations in these terms, will continue to apply.

Upon termination, we will return your horse to you or arrange for its transport at your expense, provided that all outstanding fees have been paid in full.

17. Governing Law and Dispute Resolution

These terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. You agree that any dispute arising out of or related to these terms shall be subject to the exclusive jurisdiction of the state and federal courts located in Utah.

Before initiating any formal legal proceeding, you agree to contact us to attempt to resolve the dispute informally. We will work with you in good faith to reach a resolution. If we are unable to resolve the dispute informally within a reasonable period, either party may pursue available legal remedies.

Any claim or cause of action you may have arising out of these terms or our services must be commenced within one year after the claim arises, to the extent permitted by applicable law.
